One local man indicted for illegal voting

ERATH COUNTY (March 21, 2017) – The Erath County Grand Jury today issued an indictment of Jason Preston Gross for the offense of Illegal Voting. On November 8, 2016, in the recent presidential, state, and local election, the defendant voted for a second time, having already cast a ballot in early voting.

Election officials identified Gross immediately as a person who had already cast a ballot, and inquired of Gross as to whether he had already voted. Despite being warned of the illegality of voting twice, Gross persisted in his claim that he had not previously voted and was allowed to cast a provisional ballot. Upon review of photographic and video recordings of the polling places, Elections Coordinator Susan Driskill and County Clerk Gwinda Jones confirmed that Gross had voted twice in the election, and law enforcement was notified. Further investigation by the District Attorney’s Office and Dublin Police Department Detective Nancy Wilson established that Gross purposely, rather than inadvertently, voted twice in the election.

Gross’ provisional ballot was not counted in the official election results Illegal Voting is a Second Degree Felony carrying a range of punishment of two to twenty years in prison.

It is important for the integrity of our elections that people who attempt to undermine our voting procedures be vigorously investigated and prosecuted. It is a testimony to the diligence of our election authorities and our County Clerk’s voting systems that this violation was caught immediately and confirmed through security systems in place.
