Former Erath County Constable Lee Roy Gaitan charged with felony

ERATH COUNTY (March 13, 2020) – On Thursday, March 12, the Erath County Grand Jury handed down the indictment of Lee Roy Gaitan for Theft of a Firearm by a Public Servant, a third degree felony.

The case is the result of an investigation conducted by the Texas Rangers Division of the Texas Department of Public Safety following Mr. Gaitan’s resignation as Constable for Precinct 2. The charge is based on information that a county-owned and issued firearm had been pledged and surrendered as security (collateral) for a personal loan in 2017.

Gaitan’s bond was set at $5,000. He posted bond and was out of the Erath County Jail as of Friday morning.

Local District Attorney Alan Nash said more information will be available through and following the trial of this matter which is expected to happen later this year.
