ERATH COUNTY (November 14, 2016) – While the case against an accused armed robber was set for trial on Monday, the proceeding was delayed.

Defense attorney Shay Isham filed a motion on his client’s behalf, saying Matthew James Comer, 31, isn’t competent to stand trial on the first-degree felony offense.

Assistant District Attorney Jett Smith said Monday that the case against Comer will not proceed until after the evaluation of the defendant’s mental status.

Comer is accused of robbing a gas station and convenience store at knifepoint. The aggravated robbery occurred around 1:30 a.m. on Sunday, September 13, 2015, at Food Plaza in the 2900 block of West Washington Street in Stephenville.

The suspect, later identified as Comer, fled the scene in a Dodge Neon with cash he allegedly looted from the store and a tank of pilfered gasoline.

Hours later and about 140 miles away, Comer was arrested on unrelated charges and booked into the Rockwall County Jail.

He has remained in the Erath County Jail, where he is being held in lieu of a $200,000 bond, since July 13.
